Federal Energy Regulatory Commission (FERC) V. Missouri Home Owners

 

Congresswomen Vicky Hartzler, R-Cass County, introduced H.R. 3244  “The Landowner Protection Act of 2011,” in order  to protect property rights in Missouri.  The bill would amend " the Federal Power Act to prohibit the Federal Energy Regulatory Commission (FERC) from requiring the removal or modification of existing structures or encroachments in licenses of the Commission.”  The bill is designed to place limits on FERC's authority over how Ameren Missouri manages its property at Lake of the Ozarks.

The controversy began when a new shoreline management plan from FERC was released this year which if implemented could lead to the removal of nearly  4,000 structures including private homes from the lake area.  Although the matter is under appeal, a grassroots movement supported by members of Congress from Missouri has emerged to figh FERC.   A consequence of the grassroots movement is the introduction of H.R. 3244
