Petition to Defend the Right to Trial and Due Process

Whereas: The U.S. Congress passed the FY 2012 NDAA with a provision codifying presidential authority to indefinitely detain Americans; and

Whereas: America has a long tradition of trial by jury as a cornerstone of its Republican form of government; and

Whereas: The U.S. Congress failed to reinstate Americans' full due process rights with the passage of the FY 2015 NDAA; and

Whereas: The detention of persons of Japanese descent during World War II, based solely on their race, shows the danger of the United States government arbitrarily and indefinitely detaining U.S. citizens not engaged in combat without trial; and

Whereas: The United States Constitution provides that the federal government is authorized to only exercise those powers enumerated to it in the Constitution, and the Ninth and Tenth Amendments provide that all other powers are reserved to the States.

Therefore, be it resolved that it is necessary for the State of Minnesota to defend its citizens' constitutional rights by opposing an attempt to carry out the unlawful arrest or detention of an American under the authority conveyed by the NDAA.

Be it further resolved, that it is necessary for the State of Minnesota to defend its citizens' constitutional rights by denying federal authorities any assistance in attempting to carry out the unlawful arrest or detention of an American under the authority conveyed by the NDAA.
