Whereas: Senator Jeff Klein has introduced S. 6279-2015, which would deny Second Amendment rights to New York residents on secret federal watch lists by DENYING firearm sales to citizens, and
Whereas: This legislation would also require the state police to CONFISCATE firearms lawfully owned by New York residents, and
Whereas: Civil rights groups identify these watch lists as so fraught with errors that 40 percent of the names are “false positives” of people who have no connection to terrorism, and
Whereas: Citizens are DENIED due process because they have no way of knowing in advance if they are on the list and there is no easy or clear way to be removed from the list when wrongfully placed, and
Whereas: The Supreme Court in the Heller v. D.C. decision upheld that the Second Amendment is an individual civil right, and
Whereas: Section 1 of the Fourteenth Amendment to the Constitution of the United States says, “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”
Therefore, be it resolved that we, the undersigned, call on our state senators and assembly members to REJECT Sen. Jeff Klein’s S. 6279.
Be it further resolved that we, the undersigned, call on Gov. Andrew Cuomo to ABANDON any attempt to obtain these secret and flawed federal lists for use by New York State, and that all other attempts by lawmakers to enact similar legislation be blocked.
