Stop ObamaCare in Delaware

For the first time in America’s history, all citizens will be forced to purchase health care under a federal package of health insurance mandates signed into law on March 23, 2010.

The law claims to protect Americans from the worst insurance industry practices when in fact it will increase the cost of health care, decrease your choices, and force YOU to pay for other people’s health insurance.

The Supreme Court has failed to uphold the Constitution and strike down this unconstitutional federal law.

And the state of Delaware failed to protect its citizens when the 147th General Assembly passed House Bill #162 w/HA1, to bring the health insurance provisions of the Delaware Insurance Code in compliance with ObamaCare.

House Bill #162 w/HA1 has since been signed into law by Governor Markell.

The federal government should NOT be in charge of your personal medical decisions and private medical records.

Whereas: The Tenth Amendment of the Constitution of the United States reads as follows: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."; and

Whereas: The Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and

Whereas: The scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and

Whereas: Today, the states are demonstrably treated as agents of the federal government; and

Whereas: The Tenth Amendment assures that we, the people of the United States of America and each sovereign state in the Union of States, now have, and have always had, rights the federal government may not usurp; and

Whereas: The 147th General Assembly of Delaware passed House Bill #162 w/HA1 to bring the health insurance provisions of the Delaware Insurance Code in compliance with the Patient Protection and Affordable Care Act (“PPACA”); and

Whereas: The Governor of the State of Delaware signed House Bill #162 w/HA1 on July 15th, 2013.

Therefore: I demand that the Delaware State House, Delaware State Senate, and Delaware Governor REPEAL House Bill #162 w/HA1 of the 147th General Assembly in its entirety and deny all funding from the federal government related to implementing the provisions of the Patient Protection and Affordable Care Act (“PPACA”).
